Dept. of General Services releases memo on personal services contracts per AB 906

The Department of General Services (DGS) issued a statewide management memo on Thursday outlining a new requirement related to personal services contracts with technology and other private companies, stating the state must first notify state employees to see if state staff can fulfill the requirements in the contract.

Assembly Bill 906, authored by Assemblymember Richard Pan and signed by the governor last October, requires that a government agency or department about to enter into a personal services contract notify the State Personnel Board. The Board must then contact all organizations that represent state employees who perform the type of work to be contracted.

The DGS will be in charge of establishing the process to make sure AB 906 is followed.

The management memo issues the requirements that along with the notice of the contract, the employee organizations will also be provided a full copy of the proposed contract as soon as it is finished. If there is an emergency situation where this is not possible, the memo continues, the employee organization needs to be notified as soon as possible.
