DGS Alerts Tech Vendors to New GenAI Rules in State Contracts

The notice invites interested vendors to attend a virtual forum, co-presented by the Department of General Services and the California Department of Technology, to discuss the draft GenAI contract language and GenAI Special Provisions.

The California Department of General Services (DGS) is alerting technology vendors who do business with state government to changes in the state’s Information Technology General Provisions related to generative artificial intelligence (GenAI).

In a DGS Broadcast Bulletin issued Monday, DGS directs vendors who contract with the state to disclose when and how GenAI is used in solutions, as well as to follow protocols on data sourcing and privacy, among other requirements.

The notice invites interested vendors to attend a virtual forum, co-presented by DGS and the California Department of Technology, to discuss the draft GenAI contract language and GenAI Special Provisions. The event will run from 10-11 a.m. Dec. 16, and the registration deadline is 5 p.m. Dec. 9. In addition, DGS will accept written feedback about the new contract requirements until 5 p.m. Dec. 19 via email to PPO@dgs.ca.gov.

The general provisions include:
  • Definitions related to AI technology
  • Disclosure obligations
  • Contractors’ obligations for responsible use
  • GenAI training data ownership
  • Rights to state-generated data
  • Contractors’ use of state data
The special provisions address:
  • GenAI training data
  • GenAI security requirements
  • Confidentiality and rights related to data and prompts
  • GenAI training and generated-data review
